NETELLER Invite friends programme

The NETELLER Invite Friends Programme (“Invite Friends Programme”) allows you to receive a Bonus, as defined herein, from NETELLER for referring prospective New Customers to sign up for a NETELLER Account.
Below are the terms and conditions (the “Terms and Conditions”), applicable to the Invite Friends Programme. Please read them carefully. By referring a friend to the Invite Friends Programme, you will be deemed to have accepted and be bound by these Terms and Conditions.
The NETELLER Terms Of Use, as amended from time to me, are incorporated into and form part of these Terms and Conditions and shall apply to you. In the event of any inconsistency between any of the provisions of the NETELLER Account Terms of Use and these Terms and Conditions, to the extent of the inconsistency, these Terms and Conditions will prevail.
1. Definitions and Interpretation
1.1. Unless stated otherwise, capitalized words here shall have the same meaning as in the NETELLER Account Terms of Use.
1.2. The following terms when used in these Terms and Conditions shall have the following meaning:
Applicable Laws and Regulations means any law, statute, rule, regulation, order, circular, decree, directive, judgment, decision or other similar mandate of any applicable central, national, state or local governmental authority having competent jurisdiction over, or application, to the Party, a Referred Customer, or subject matter in question.
Approved Media means social media websites (such as Facebook, Whatsapp Twitter, LinkedIn, Skype, Instagram), webpages, mobile platforms or applications.
Bonus means the Bonus payable by NETELLER to you for the referral of New Customers to the NETELLER Services in accordance with section 4.2 (Bonus).
Customer Account means the electronic money account registered with NETELLER in the name of a customer.
New Customer means a consumer who, at the time of the referral by you to NETELLER in accordance with section 3 (Referrals), does not have an existing Customer Account.
Prohibited Activities means the activities set out in section 5 (Prohibited Activities) or any other activities notified to you by NETELLER from time to time.
Referral Link means a link provided to you by NETELLER through your Customer Account for the purposes of allowing New Customers to apply for a Customer Account.
Referred Customer means a New Customer who was referred by you to the NETELLER Services using the Referral Link, has registered a Customer Account in accordance with the NETELLER Account Terms of Use and who has successfully satisfied the Eligibility Criteria in section 2.
Referred Customer Account means the Customer Account of a New Customer that has been tagged to you for the purposes of generating a Bonus.
NETELLER means Paysafe Financial Services Limited, a company regulated by the Financial Conduct Authority. We are incorporated under the laws of England and Wales with company registration number 4478861 and are authorised as an electronic money and payments instrument institution. Our Financial Conduct Authority registration number is FRN 90001.
NETELLER Services means the services provided by NETELLER which includes (but is not limited to) the issuance of electronic money and related payment processing services for the purpose of the Customer Account.
Tagged Account means the Customer Account of a Referred Customer that has been tagged to the referrer’s Customer Account for the purpose of generating Bonus(s).
1.3. The NETELLER Terms Of Use, as amended from time to time, are incorporated into and form part of these Terms and Conditions and apply to the referrer and the referrer’s Customer Account.
2. Eligibility Criteria
2.1. In order to participate in the Invite Friends Programme, you must:
(i) have an active NETELLER Account;
(ii) have acquired a NETELLER True status following the steps shown here;
(iii) not use your NETELLER Account for commercial purposes;
(iv) not be a service provider or a direct family member of a service provider of any company in the Paysafe group;
(v) be at least 18 years of age; and
(vi) not reside in the United States.
3. Referrals
3.1. You shall co-operate in good faith with NETELLER to promote and refer the NETELLER Services to New Customers in accordance with these Terms and Conditions. You acknowledge and agree that NETELLER may in its sole discretion decide whether or not to accept New Customers as Referred Customers.
3.2. The legal relationship between NETELLER and any Referred Customer will be the sole remit and responsibility of NETELLER. With the exception of section 4.2 (Bonus(s)) NETELLER will not be liable to provide you any details of such relationships.
3.3. You shall not have any power to accept Referred Customers or make contracts on behalf of NETELLER and shall not make or give any promises, representations, warranties or guarantees, whether expressed or implied, to a New Customer on behalf of NETELLER.
4. Invite Friends Programme – How It Works
4.1. Referral Link
Upon using the Skrill Service and satisfying the Eligibility Criteria you will automatically receive a Referral Link in the “Invite Friends” section of you Skrill Account that can be shared with an unlimited number of friends and family members in order for you and them to become eligible for and receive Bonuses.
4.2. Bonus
(i) You can earn a Bonus if: (i) a prospective Referred Customer clicks on your Referral Link to create an eligible New Customer Account that complies with the NETELLER Account Terms Of Use and thus becomes a Referred Customer; and (ii) the Referred Customer satisfies the Eligibility Criteria. If (i) and (ii) are fulfilled, both you and the Referred Customer will receive a Bonus that can be used in your next transaction.
(ii) You may invite any number of friends and family to use the NETELLER Services but you will only receive Bonuses to the aggregate amount of EUR 200 for all Referred Customers. Once that amount is hit, you will no longer be eligible to receive further Bonuses but, if you wish, you may continue referring prospective New Customers to NETELLER.
(iii) All Bonuses are paid inclusive of VAT, where applicable. NETELLER shall not be responsible for any taxes, duties, assessments, fines or levies or other amounts payable by you to any governmental or regulatory authority arising out of your participation in the Invite Friends Programme. You are responsible for reporting any taxes owed in relation to revenues earned through the Invite Friends Programme.
(iv) NETELLER reserves the right to change the applicable Bonus by giving you thirty (30) days’ written notice sent to the primary email address registered to your NETELLER Account.
(v) NETELLER shall also in its sole discretion have the right to withhold the whole or part of any payment of the Bonus where it reasonably suspects or knows that any of the Prohibited Activities referred to herein has taken place.
(vi) For the purpose of calculating the Bonus, NETELLER reserves the right to disregard all activities that NETELLER, in its sole but reasonable discretion, deems an abuse of the Invite Friends Programme, including but not limited to:
a) transactions that are prohibited under these Terms and Conditions; or
b) transactions that are prohibited under the NETELLER Account Terms of Use.
4.3. Sharing Referral Links
(i) Referrer can share a Referral Link: (1) by copying and sending it to prospective Referred Customers; (2) via email in a link or (3) by sharing a link on Approved Media.
(ii) Referral Links must only be used for personal and non-commercial purposes. Referral Links must only be published or distributed on Approved Media. Referrers are prohibited from “spamming” anyone with referral invitations or posting their Referral Links as well as any personal data of the prospective Referred Customers on third parties’ websites. This includes bulk emailing, texting or messaging unknown people as well as using automated systems or bots through any channel for the purpose of distributing your referral link. You are strictly prohibited from paying to advertise their referral links. NETELLER reserves the right to sanction any such activity in its sole and reasonable discretion.
4.4. Referred Customers
Referred Customers who have signed up using a valid Referral Link or have submitted the Referral Link upon successfully fulfilling the Eligibility Criteria will also receive a Bonus that can be used immediately with their first transaction using the NETELLER Services.
5. Prohibited Activities
5.1 You shall not, and shall ensure that Referred Customers do not, perform any of the following activities:
(i) open or operate multiple Customer Accounts without the prior written consent of NETELLER;
(ii) register a Customer Account on behalf of another person;
(iii) offer incentives or rewards to New Customers to encourage them to apply for a Customer Account;
(iv) create or employ any mechanism designed to artificially or automatically generate sign-ups to the NETELLER Services or the Invite Friends Programme;
(v) take any action designed to or which is likely to induce, encourage or cause any Referred Customer to modify his or her existing terms with NETELLER or to terminate his or her existing relationship with NETELLER for any purpose, including for the purpose of re-registering such Referred Customer so as generate additional Bonuses;
(vi) use counterfeit, forged, imitated, stolen or otherwise altered identification documents;
(vii) cause, endorse, advise or approve any type of practice that enables itself or Referred Customers to breach or circumvent any of NETELLER’s security or verification or other compliance procedures, which includes but is not limited to making fraudulent or abusive transactions, and opening multiple accounts in breach of the NETELLER Account Terms of Use, these Terms and Conditions, as well as any other terms and conditions available on NETELLER’s webpages as such terms and conditions pertain to the operation of the Invite Friends Programme;
(viii) use or create any material that is sexually explicit, offensive, profane, hateful, threatening, harmful, graphically violent, defamatory, libellous, harassing, or discriminatory (whether based on race, ethnicity, creed, religion, gender, sexual orientation, or physical disability);
(ix) make or knowingly benefit from transactions which NETELLER in its sole discretion deems to be suspicious, unauthorized, fraudulent or malicious including without limitation transactions that relate to money laundering, terrorism financing, fraud or other illegal activities; or
(x) conduct any activity that is in breach of the NETELLER Account Terms of Use.
5.2 NETELLER may terminate with immediate effect any relationship under these Terms and Conditions where NETELLER has detected, in its sole but reasonable opinion, abuse of these Terms and Conditions. NETELLER further reserves the right to amend, suspend or terminate these Terms and Conditions at any time, without notice, should there be any risk to the continued security, fairness or integrity of the Invite Friends Programme.
6. Warranties
You warrant, represent and undertake to NETELLER that:
(i) you shall not engage in the distribution of any bulk emails (spam) in any way mentioning or referencing NETELLER, other Paysafe Group companies or any NETELLER products or services;
(ii) you shall comply with all applicable laws and regulations;
(iii) you shall not breach or attempt to circumvent NETELLER’s security or verification procedures; and
(iv) you shall only share your Referral Link with third-parties so that they may sign up for a NETELLER Account.
7. Privacy and personal data
7.1. Processing of personal data is governed by the Paysafe Privacy Notice which can be found on NETELLER’s website. Additional information may be required by NETELLER to verify compliance with these Terms and Conditions.
7.2. Within your NETELLER Account you will be able to see the details of the Bonus earned in respect of each of your Referred Customers. You must obtain consent from each of your Referred Customers to view this information prior to referring them. By using the Referral Link you are confirming that you have obtained such consent from the Referred Customer.
8. Changes to Terms and Conditions
8.1. NETELLER reserves the right to change these Terms and Conditions at any time including the right to withdraw the Invite Friends Programme completely.
8.2. Subject to section 8.3 below, changes will be communicated via e-mail to the primary email address registered to your NETELLER Account. The proposed change will come into effect 30 days after the notice is deemed to be delivered (see section 17.1 of the NETELLER Account Terms of Use), unless you give us written notice that you object to the proposed change. Your objection notice shall be deemed to constitute a notice to terminate your participation in the Invite Friends Programme and these Terms and Conditions will no longer apply to you.
8.3. The 30 days’ notice period shall not apply where we believe, in our reasonable opinion, that the change neither reduces your rights nor increases your obligations. In such instances, the change will become effective immediately without prior notice.
9. Termination
9.1. NETELLER reserves the right to end the Invite Friends Programme at any time in its sole discretion by giving you 30 days written notice sent to the primary email address registered to your NETELLER Account.
9.2. In the event NETELLER ends the promotion under section 9.1 of these Terms and Conditions, NETELLER shall continue paying the Bonus in respect of your existing Referred Customers until our liability to pay Bonus has expired in accordance with section 4.2 or 5.2 of these Terms and Conditions.
9.3. NETELLER may immediately terminate your participation in the Invite Friends Programme in the following circumstances:
- you commit a material breach of these Terms and Conditions or the NETELLER Account Terms of Use; or
- NETELLER in its sole but reasonable discretion believes you or one of your Referred Customers has conducted a Prohibited Activity as set out in section 5 of these Terms and Conditions;
9.4. If NETELLER terminates your participation in the Invite Friends Programme under section 9.3 of these Terms and Conditions, NETELLER shall stop paying Bonus to you immediately upon termination.
10. Dispute Process/Limitation of Liability/Indemnification
If for any reason you believe that there is a discrepancy regarding your Bonuses, please contact us. NETELLER may require you to submit additional information in order to make a determination regarding a Bonus. NETELLER shall use reasonable commercial efforts to investigate and resolve any errors or discrepancies and pay any outstanding Bonus to you. All decisions regarding your Bonus will be final and at NETELLER’s sole discretion. To the extent permitted by law, you hereby release and discharge NETELLER from any and all liability with respect to paying any unpaid Bonuses that may otherwise have been payable to you.
11. General
11.1. These Terms and Conditions shall be governed by and interpreted in accordance with the laws of England and Wales. Any dispute under these Terms and Conditions or otherwise in connection with your NETELLER Account shall be brought exclusively in the courts of England.
11.2. If there is any discrepancy between any translated version and the original English version of these Terms and Conditions, the English version shall prevail.
11.3. The Invite Friends Programme shall not be construed to create any employment relationship, agency relationship or partnership between you and NETELLER or any Paysafe group company.
11.4. If any part of these Terms and Conditions is found by a court of a competent jurisdiction to be invalid, unlawful or unenforceable then such part shall be severed from the remainder of the Terms and Conditions, which shall continue to be valid and enforceable to the fullest extent permitted by law.
